Terms of Service and Privacy Policy for the MusterPointEvents app. Last updated September 7, 2026.

Effective Date: September 7, 2026 Last Updated: September 7, 2026

These Terms of Service ("Terms") are a binding legal agreement between you and MusterPoint LLC, a Nebraska limited liability company ("MusterPoint," "we," "us," or "our"), governing your access to and use of the MusterPointEvents mobile application, related websites, and any associated services (collectively, the "Service").

PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER (SECTION 15) THAT AFFECT YOUR LEGAL RIGHTS. BY CREATING AN ACCOUNT, DOWNLOADING, INSTALLING, OR USING THE SERVICE, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

1. Eligibility

1.1. You must be at least 18 years of age to create an account or use the Service. By using the Service, you represent and warrant that you meet this requirement.

1.2. You may not use the Service if you have previously been suspended or removed from it, or if you are prohibited from receiving services under the laws of the United States or any other applicable jurisdiction.

1.3. Nothing in these Terms requires you to be a veteran, service member, or affiliated with any military organization. Where the Service allows you to indicate military affiliation, you agree to provide accurate information.

2. Your Account

2.1. To use certain features, you must register for an account. You agree to provide accurate, current, and complete information and to keep it updated.

2.2. You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at Headquarters@musterpoint.us of any unauthorized use.

2.3. You may not share your account, create an account for anyone other than yourself, or create multiple accounts without our permission.

2.4. Account Deletion. You may delete your account at any time through the in-app account settings. Deletion is permanent and cannot be reversed. Deleting your account does not cancel any completed transactions or entitle you to a refund except as provided in Section 6. See our Privacy Policy for what happens to your data after deletion.

3. The Service

3.1. The Service allows users to view and RSVP to events organized by MusterPoint, purchase admission to certain paid events, make voluntary donations, and receive communications about events and activities.

3.2. The Service is free to download and free to use. Fees are charged only for admission to specific paid events, as displayed at the time of purchase, and for any voluntary donations you choose to make.

3.3. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, and we will not be liable to you for doing so.

4. Events

4.1. Event Information. Event details (including date, time, location, cost, and capacity) are provided for informational purposes and may change. We will make reasonable efforts to communicate material changes, but we do not guarantee that any event will take place as described.

4.2. RSVPs. An RSVP is a non-binding indication of your intent to attend a free event. RSVPs may be subject to capacity limits. Submitting an RSVP does not guarantee admission.

4.3. Paid Events. Purchasing admission to a paid event grants you a revocable, non-transferable license to attend that event, subject to these Terms and any event-specific rules communicated to you.

4.4. Cancellation or Changes by Us. If we cancel a paid event, you will receive a refund of the admission fee paid through the Service. If we materially reschedule or relocate an event, we will offer you the option of a refund. Refunds are our sole liability for event cancellations or changes; we are not responsible for any travel, lodging, or other costs you incur.

4.5. Conduct at Events. You agree to comply with all event rules, venue policies, instructions of event staff, and applicable laws. We may remove any person from an event, without refund, for conduct that we reasonably determine to be unsafe, disruptive, unlawful, or in violation of these Terms.

4.6. Assumption of Risk. Some events may involve physical activity, outdoor settings, travel, alcohol service, firearms-related activities, or other inherent risks. YOU VOLUNTARILY ASSUME ALL RISKS OF ATTENDING ANY EVENT, INCLUDING THE RISK OF PERSONAL INJURY, PROPERTY DAMAGE, OR DEATH. We may require a separate waiver or release for specific events; where we do, that document governs the event in addition to these Terms.

4.7. Third-Party Venues and Vendors. Events may be held at venues, or involve vendors, that we do not own or control. We are not responsible for the acts, omissions, or policies of any third-party venue or vendor.

4.8. Photography and Recording. By attending an event, you consent to being photographed or recorded and to our use of such images or recordings in connection with the promotion of MusterPoint and its activities, without compensation. To opt out for a specific event, notify event staff before the event begins.

5. Payments

5.1. Payment Processor. All payments are processed by Stripe, Inc. ("Stripe"). We do not collect, store, or have access to your full payment card number. By making a payment, you agree to Stripe's Services Agreement (https://stripe.com/legal) and Privacy Policy (https://stripe.com/privacy).

5.2. Authorization. By submitting payment information, you authorize us and Stripe to charge the payment method you provide for the amount displayed, plus any applicable taxes or processing fees disclosed at checkout.

5.3. Accuracy. You represent that you are authorized to use the payment method you provide and that all payment information is accurate.

5.4. Pricing. All prices are in U.S. dollars unless otherwise stated. We may correct pricing errors at any time, including after an order is placed; if we do, we will notify you and give you the option to cancel for a full refund.

5.5. Chargebacks. If you initiate a chargeback or payment dispute that we reasonably believe is unjustified, we may suspend your account pending resolution and may recover any amounts owed, including our reasonable costs.

6. Refunds

6.1. Paid Event Admission. [CHOOSE ONE AND DELETE THE OTHER:] - Option A: Admission fees are non-refundable except as provided in Section 4.4 (cancellation or material change by us) or as required by law. - Option B: You may request a refund of an admission fee up to [NUMBER] days before the event start time by contacting Headquarters@musterpoint.us. Requests made after that deadline will not be honored except as provided in Section 4.4 or as required by law.

6.2. Refund Method. Approved refunds are issued to the original payment method and may take 5–10 business days to appear, depending on your financial institution.

6.3. No Cash Value. Event admission has no cash value and may not be resold or exchanged for cash.

7. Donations

7.1. Donations made through the Service are voluntary, final, and non-refundable, except where we determine a donation was made in error and you contact us within [7] days.

7.2. Tax Status. MusterPoint LLC is a limited liability company. UNLESS WE EXPRESSLY STATE OTHERWISE IN WRITING, DONATIONS TO MUSTERPOINT ARE NOT TAX-DEDUCTIBLE AS CHARITABLE CONTRIBUTIONS UNDER SECTION 170 OF THE INTERNAL REVENUE CODE. You are responsible for consulting your own tax advisor regarding the treatment of any donation.

7.3. We will use donations in our reasonable discretion to support the activities and mission of MusterPoint. Donations are not restricted to any specific purpose unless we expressly agree in writing.

8. Acceptable Use

You agree that you will NOT:

(a) Use the Service for any unlawful purpose or in violation of any applicable law or regulation; (b) Impersonate any person or entity, misrepresent your affiliation with any person or entity, or falsely claim military service or status; (c) Harass, threaten, intimidate, defame, or abuse any other user, event attendee, or MusterPoint personnel; (d) Upload or transmit content that is unlawful, obscene, hateful, discriminatory, or infringes any third party's rights; (e) Attempt to gain unauthorized access to the Service, other users' accounts, the administrative dashboard, or any connected system or network; (f) Use any automated means (bots, scrapers, crawlers) to access the Service without our written permission; (g) Interfere with, disrupt, or place an unreasonable load on the Service or its infrastructure; (h) Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service, except to the extent such restriction is prohibited by law; (i) Copy, modify, distribute, sell, lease, or create derivative works of the Service or any part of it; (j) Remove or alter any copyright, trademark, or other proprietary notice; (k) Use the Service to send unsolicited commercial messages; (l) Submit false RSVPs, fraudulent payments, or otherwise manipulate event attendance or capacity; or (m) Assist or encourage any third party to do any of the foregoing.

9. Administrative Access

9.1. Certain features of the Service (the "Admin Dashboard") are restricted to authorized MusterPoint personnel and protected by access credentials. Any attempt by a non-authorized user to access the Admin Dashboard is a material breach of these Terms and may violate the Computer Fraud and Abuse Act (18 U.S.C. § 1030) and similar state laws.

9.2. Authorized administrators agree to keep their credentials confidential, to use administrative access only for legitimate MusterPoint purposes, and to handle user data in accordance with our Privacy Policy and applicable law.

10. User Content

10.1. The Service may allow you to submit content such as a profile name, profile photo, comments, or messages ("User Content"). You retain ownership of your User Content.

10.2. By submitting User Content, you grant MusterPoint a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute your User Content solely for the purpose of operating, promoting, and improving the Service.

10.3. You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate these Terms or any third party's rights.

10.4. We may, but are not obligated to, monitor, review, or remove User Content at our sole discretion and without notice.

11. Intellectual Property

11.1. The Service, including its software, design, text, graphics, logos, the "MusterPoint" and "MusterPointEvents" names and marks, and all related intellectual property, is owned by or licensed to MusterPoint and is protected by United States and international copyright, trademark, and other laws.

11.2. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download and use the Service on a mobile device that you own or control, solely for your personal, non-commercial use.

11.3. All rights not expressly granted to you are reserved by MusterPoint.

11.4. Feedback. If you submit suggestions, ideas, or feedback about the Service, you grant us an unrestricted, perpetual, irrevocable right to use them without compensation or attribution.

12. Third-Party Services

12.1. The Service relies on third-party services, including Stripe (payments), Apple Inc. (App Store, iOS), Google LLC (Google Play, Android), and [NO-CODE/BACKEND PLATFORM, e.g., FlutterFlow / Firebase] (hosting and infrastructure). Your use of those services is subject to their own terms and policies.

12.2. The Service may contain links to third-party websites or resources. We are not responsible for their content, accuracy, or practices, and linking does not imply endorsement.

13. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL EVENTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. MUSTERPOINT EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY EVENT WILL OCCUR AS SCHEDULED OR MEET YOUR EXPECTATIONS.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

(a) IN NO EVENT WILL MUSTERPOINT, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, VOLUNTEERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR USE, ARISING OUT OF OR RELATING TO THE SERVICE, ANY EVENT, OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(b) OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE, ANY EVENT, OR THESE TERMS WILL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID TO US THROUGH THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (ii) ONE HUNDRED U.S. DOLLARS ($100).

(c) THE LIMITATIONS IN THIS SECTION ARE FUNDAMENTAL ELEMENTS OF THE BARGAIN BETWEEN YOU AND MUSTERPOINT, AND THE SERVICE WOULD NOT BE PROVIDED WITHOUT THEM.

Some jurisdictions do not allow the limitation of liability for certain damages, so some of the above limitations may not apply to you. Nothing in these Terms limits liability for fraud, willful misconduct, or any liability that cannot be limited by law.

15. Dispute Resolution; Binding Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO ARBITRATE DISPUTES AND LIMITS THE WAYS YOU CAN SEEK RELIEF.

15.1. Informal Resolution. Before filing a claim, you agree to contact us at Headquarters@musterpoint.us with a written description of the dispute and to attempt in good faith to resolve it informally for at least thirty (30) days.

15.2. Binding Arbitration. Except as provided in Section 15.4, any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or any event ("Dispute") will be resolved exclusively by final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, before a single arbitrator. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this Section.

15.3. Arbitration Procedure. Arbitration will take place in [Lancaster County, Nebraska], or by video conference or on written submissions if the arbitrator determines an in-person hearing is unnecessary. The arbitrator's decision will be final and may be entered as a judgment in any court of competent jurisdiction. Each party will bear its own attorneys' fees unless the arbitrator awards fees under applicable law. AAA filing fees will be allocated according to the AAA Consumer Arbitration Rules.

15.4. Exceptions. Either party may (a) bring an individual action in small claims court for Disputes within that court's jurisdiction, or (b) seek injunctive or other equitable relief in court to protect its intellectual property rights or to prevent unauthorized access to the Service.

15.5. CLASS ACTION WAIVER. YOU AND MUSTERPOINT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS OR PRESIDE OVER ANY FORM OF REPRESENTATIVE PROCEEDING. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) will be severed and proceed in court, and the remainder will proceed in arbitration.

15.6. Opt-Out. You may opt out of this arbitration agreement by sending written notice to Headquarters@musterpoint.us within thirty (30) days of first accepting these Terms, stating your name, account email, and that you wish to opt out. Opting out does not affect any other provision of these Terms.

15.7. Jury Trial Waiver. To the extent any Dispute proceeds in court rather than arbitration, YOU AND MUSTERPOINT EACH WAIVE ANY RIGHT TO A JURY TRIAL.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Nebraska and applicable federal law, without regard to conflict-of-law principles. Subject to Section 15, you agree to the exclusive jurisdiction of the state and federal courts located in [Lancaster County, Nebraska] for any action not subject to arbitration.

17. Indemnification

You agree to defend, indemnify, and hold harmless MusterPoint and its members, managers, officers, employees, volunteers, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service or attendance at any event; (b) your User Content; (c) your violation of these Terms or any applicable law; or (d) your violation of any third party's rights. We reserve the right to assume the exclusive defense of any matter subject to indemnification, in which case you agree to cooperate with us.

18. Termination

18.1. We may suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including violation of these Terms.

18.2. Upon termination, your license to use the Service ends immediately. Sections 4.6, 7, 10.2, 11, 13, 14, 15, 16, 17, 18.2, and 21 survive termination.

19. Apple App Store Additional Terms

If you downloaded the Service from the Apple App Store, the following applies:

(a) These Terms are between you and MusterPoint only, not Apple. Apple is not responsible for the Service or its content. (b) Your license is limited to use on Apple-branded devices that you own or control, as permitted by the App Store Usage Rules. (c) Apple has no obligation to provide maintenance or support for the Service. (d) In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the Service to you. To the maximum extent permitted by law, Apple has no other warranty obligation. (e) Apple is not responsible for addressing any claims relating to the Service, including product liability claims, claims that the Service fails to conform to legal or regulatory requirements, or consumer protection claims. (f) In the event of a third-party claim that the Service infringes intellectual property rights, MusterPoint, not Apple, is responsible for the investigation, defense, settlement, and discharge of such claim. (g) You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. (h) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

20. Google Play Additional Terms

If you downloaded the Service from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and has no obligation or liability to you with respect to the Service.

21. General Provisions

21.1. Entire Agreement. These Terms, together with the Privacy Policy and any event-specific waivers or rules, constitute the entire agreement between you and MusterPoint regarding the Service and supersede all prior agreements.

21.2. Changes to Terms. We may modify these Terms at any time. We will post the updated Terms in the Service and update the "Last Updated" date. Material changes will be communicated by in-app notice or email. Your continued use of the Service after changes take effect constitutes acceptance. If you do not agree, you must stop using the Service and may delete your account.

21.3. Severability. If any provision is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force.

21.4. Waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.

21.5. Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.

21.6. Force Majeure. We are not liable for any failure or delay caused by circumstances beyond our reasonable control, including acts of God, weather, pandemic, war, terrorism, civil unrest, labor disputes, government action, or failures of third-party services or infrastructure.

21.7. No Third-Party Beneficiaries. Except as provided in Section 19, these Terms do not confer any rights on any third party.

21.8. Electronic Communications. You consent to receive communications from us electronically, including through the Service, push notifications, and email, and agree that such communications satisfy any legal requirement that communications be in writing.

21.9. Export Compliance. You agree to comply with all applicable U.S. export laws and regulations in connection with your use of the Service.

21.10. Headings. Section headings are for convenience only and have no legal effect.
